PD and Planning permission

Hi,  I have an application for an exetnsion, part of which requires Planning permission and part of which is PD.  The individual elements are under 100sqm, but the total of both together exceeds the threshold.  I think that the two should be added together and thereby make a CIL liabile development - but the agent suggest that they should be treated independently.  Although the argument will ultimately be academic because the applicant will be able to claim self-build extension exeption I would welcome any view or experience that others can give.  In the meantime I will seek advice from Legal, too.

Paul,

I would say that if the PD element is included in the planning application, is shown on the plans and takes it over the 100 square metres then the CIL is payable.

If the agent feels that the PD element should not be included then he needs to submit a fresh application with no mention of the PD element.
