Estoppel

Council Tax and Housing Benefit has been paid by the District Council for eighteen months on a static caravan, following an inspection by them at the outset. The District Council is also the local planning authority.

I understand about the ten and four year rules with regard to planning. I, also, appreciate that an officer from the Council Tax/Housing Benefit department and not the Planning department made the inspection. As, however, they are from the same Council and have condoned the use for 18 months are they then estopped from planning enforcement. No one has complained about the use. Why I ask is because the tenant in the mobile home is vulnerable and very happy where they are, would not at all want to move and would be very difficult to rehouse.
