FOI requests for CIL info

FOI requests for CIL info

Has anyone received any FOI requests for CIL information (for example, a request for any documentation submitted to evidence continous, lawful use or for copies of liabilty notices)?  If so, how did you deal with them? If you refused to disclose the information, under what grounds?

HI Helen

Have checked with our officer that deals with CIL and all the documents are published, appropriately redacted, on our website and any FOI requests are referred to the website.

Hi Sue,

I hope your CIL notices are not redacted to the same extent as the CIL appeal decision letters on the VOA web site!

Thanks Sue. In this case the evidence provided related to some personal information about the family history so our solicitors have advised we can refuse to disclose it under Section 40(2) of the FOIA 2000.

CIL Liability and Demand Notices fall under the definition of "environmental information" for the purposes of the Environmental Information regulations. This is an extract from the guidance "For example, financial information would be classed as environmental information if it related to the costs of redeveloping land and building a new leisure complex". The rules relating to EI requests are different to those relating to FOI requests.

Notwithstanding the above, the two types of notice are registered as local land charges and therefore copies should be available on request. As with s.106 agreements, the names of the parties go to the heart of the notices and therefore we would suply unredacted copies. So far however, in two and a half years since we adopted CIL, we have not been asked for copies of any CIL notices.
