Developer Contributions SPD

The Derbyshire Dales Local Plan was adopted in 2017. The District Council has a mandate to undertake work on a Developer Contributions Supplementary Planning Document to establish contributions for affordable housing and other infrastructure.

The recently published Planning Practice Guidance states at para 004 “Plan should set out policies for the contributions expected from development to enable fair and open testing of the policy at examination. This should include setting out the levels and types of affordable housing provision required along with other infrastructure…..Supplementary planning documents should not be used to add unnecessarily to the financial burdens on development and should not be used to set rates or charges which have not been established through development plan policy.”

We would welcome your views on the interpretation of this paragraph, and indeed whether the detailed rates and charges should be set out in a Local Plan rather than SPD. Furthermore whether any Developer Contributions SPD have been prepared and challenged on this issue and if so how it was dealt with?
