We've received an enquiry from a develper about CIL exemptions:

If a development is limited to 100 square metres and is thus exempt CIL, what is the period before a second application for 100 square metres of new build

can be added, and thus be  exempt CIL?

Do the CIL Regs provide any safeguard to prevent repeated claims for exemption which each seek to use the GIA threshold exemption? I haven't been able to find any guidance under Reg 42.

CIL is charged for for the development for which a planning permission is granted. If the planning permission is for a development comprising less than 100sq m then it is exempt. The exemption does not have to be claimed.

 

If a developer is clever enough to make a series of planning applications each of which are for less than 100sq m then CIL can be avoided.
