With regards to the 5% admin charges, my understanding is that for the first 3 years the 5% can be rolled over during this time and spent by end of 3rd financial year, the 4th and subsequent years can use CIL upto 5% and must be spent by end of each financial year. Is this right? If the funds are not spent what happens to the money?

I think that's right. The Regs don't state what happens to it but I think it can only be reassigned to the central 'pot' - Guidance encourages CA's to minimise CIL admin. This would then be reported in the CIL Annual Report.
