We have an application that was granted consent prior to CIL being implemented, a S73 was subsequently approved which increased the floorspace and a charge was calculated for the net increase. We received a commencement notice and the development has started. The applicant now wants to amend the S73 application this will reduce the amount of floorspace but there will still be a charge, the amendment will be through minor amendments. If they have started the development can we change the charge? Does it make a difference that it is not a new application but an amendment?
