Where a planning permission is granted prior to the CIL
implementation date but is subject to a Universal Undertaking by the
applicant. If the UU is satisfied after the CIL implementation date,
and therefor the planning permission is implemented after the
effective CIL date, would the applicant be liable for a CIL payment?
In this situation a decision notice has been issued approving the
development, subject to the UU and other pre commencement conditions.
The CIL relates to a cessation of a Use on an adjoining site under the
control of the applicant.
