Good afternoon all,

I have a customer for whom I installed a commercial solar power system. The roof is pitched, and the panels are close to the edge (around 400mm). I am confident that we have complied with all conditions of permitted development set out in The Town and Country Planning (General Permitted Development) (England) Order 2015, part 14, whereby the limit of being 1m from the edge of the roof applies only to flat roofs. On the planning portal webiste however, the 1m limit is applied to all roofs, and the LA are seeking to use this to issue an enforcement notice against my customer. 

Does anyone have any insight into how we can use legislation rather than guidance to force the hand of the LA on this? The customer is of course apprehensive about recieving an enforcement notice and would prefer to modify the system, which seems like a rather large waste of money.

Any thoughts would be much appreciated.
