CIL - Sub-division of 1 dwelling into 2 dwellings

Hi,

We have an application for a property which is currently two 1 bedroom flats and they would like to convert the loft into a third one bedroom flat. In order for the planning application to be feasible they need to include two large dormers to convert the loft space into a one bedroom flat. As dormers are an external alteration we have considered that the planning application shouldn't be considered as a genuine sub-division of one dwelling into 2 or more dwellings should therefore be liable for CIL.

However as there is no increase in floorspace we are not sure if this is the correct interpretations of the CIL Regulations?

Any help would be much appreciated.
