Change of Use and Section 106

We are just owners of a small D1 use property in the centre of Horsham and applied for a change of use for a 1 bed ground floor flat, the upper floor was converted 3 years ago and is exactly the same size. The ground floor has added space outside for amenity area. The council are trying to levy a fee of what amounts to nearly £11,000 in the section 106 agreement. We are not developing the site, it is a change of use and no levy was required for the flat above. The council refused planning and appeal lodged, council have drawn up this section 106 agreement and we are stuck because we cant pay £11000 on a property thats only worth £100k but if we dont sign it we wont be able to proceed with anything, what rights do we have to complain about this, is any one out there can help me please?????
