CIL or SECTION106? EDUCATION & additional School Places -

We (Durham County Council) are seeking to capture developer contributions for the provision of school places post adoption of our development plan in 2014. We are considering the following approach; STRATEGIC SITES - We are currently thinking using single S106 agreements for new Schools created by strategic sites i.e by listing them as a specific infrastructure project in the IDP; and CUMULATIVE HOUSING SITES - CIL contributions for additional classrooms be put on the Reg 123 list as a generic item and paid for by CIL. Does this approach to differentiate between new schoolds and classrooms seem reasnoble? Also, should we even me seeking developer contributions for new schools when the govenrnment are seeking the provision of free schools?? Would be interested to hear other views on this issue.

Peter I know this an old thread but you may still be grappling with this issue. Yes your approach seems reasonable. It is pragmatic to distinguish between education provision secured via Section 106 (for strategic sites where you can quantify the need now); and that secured via CIL (for other sites where need is not currently known). And yes, distinguishing between classrooms and new schools is also helpful. If you know which schools, it is useful to name these and be as specific as possible, so that you can pool up to 5 contributions to each specific improvement; rather than only being able to pool 5 contributins in total to 'new schools' in general. Yes, we currently seek Section 106 contributions for primary, secondary and post-16 education - more info here: http://www.derbyshire.gov.uk/images/2012%2009%2010%20Developer%20Contributions%20Protocol_tcm44-211205.pdf We are asking our District and Borough Councils to identify any specific known need relating to strategic sites in their Local Plans and to include a developer contributions policy that allows for contributions towards school places from all other sites (where required) via either Section 106 or CIL in the future (not all of our Councils will be introducing a CIL). It is necessary to continue to seek contributions because even though the local education authority will not be running new schools, they will be academies or free schools, we still have the (financial) responsibility for providing the places (a little 'quirk' of the government's approach to education...)
