Prior notification and liability

Our Charging Schedule is likely to come into effect shortly. With the recent changes to PD in some situations under Class J the change of use of a building from an office to resi would be CIL liable. Is such a scenario where the change of use is CIL liable (putting continuous use aside) what would happen if we granted prior notification before the date the Charging Schedule came into effect (i) would the development be exempt from CIL as long as the decision was issued before 1st September or (ii) the decision is immaterial and the important date is when work commenced? From reading the Regs (64. 2010) I would assume that it would be the latter? Many thanks, Jo

Sorry if this post was unclear part (i) is on the hypothetical basis that the Charging Schedule is to take effect from 1st September. Thanks, Jo
