New Member Posts: 2 Join Date: 20/10/11 Recent PostsHi, does anybody have any advice on progressing a CIL to examination in advance of an adopted Local Plan please? Informal advice from CLG, and from PINS through presentations that I've heard, have suggested that this is acceptable, provided that the evidence base is up to date. However, having seen the recent advice of the Runnymede Inspector, he gives a very clear direction that the draft charging schedule should be withdrawn in the absence of an up-to-date plan. Any examples from elsewhere would be much appreciated!

Advocate Posts: 121 Join Date: 25/04/12 Recent PostsSince the purpose of CIL is to implement the Local Plan, it is difficult to see how you could justify a CIL in the absence of at least a Core Strategy. What would be the basis for your IDP?.
The informal advice from DCLG and PINs ( although in the case of PINs- a while back now -on a previous version of the guidance) was that if you had a strategy and up to date evidence base - IDP etc then you could progress a CIL to examination. In my view the guidance etc does clearly indicate that you have to have a relevant plan ( development plan) so I am not sure how this would work in reality. Some authorities, like London authorities, might be able to rely on the part of the development plan that does exist e.g. London Plan - if they can tell the story of their development and therefore infrastructure requirements and need for CIL.

New Member Posts: 2 Join Date: 20/10/11 Recent PostsThanks for your comments Daniel and Gilian. CIL would be on the back of our draft IDP, which will be supporting a draft Local Plan, which is likely to be going through the examination process just ahead of CIL.
If you are working the two in parallel that is considered good practice and positively encouraged.
CIL guidance – “2:2:1 What is a charging schedule? …Charging schedules are not formally part of the relevant Plan, but charging schedules and relevant Plans should inform and be generally consistent with each other. The National Planning Policy Framework in England (paragraph 175) provides that, where practical, charging schedules should be worked up and tested alongside the Local Plan. The same principles apply in Wales (see paragraph 2.1.1 of Planning Policy Wales). A charging authority may use a draft plan if they are proposing a joint examination of their relevant Plan and their levy charging schedule….”
NPPF-
175. Where practical, Community Infrastructure Levy charges should be worked
up and tested alongside the Local Plan. The Community Infrastructure Levy
should support and incentivise new development, particularly by placing
control over a meaningful proportion of the funds raised with the
neighbourhoods where development takes place.
Croydon worked up the two of them sucessfully and had back to back examinations with the same Inspector.
