Wain homes- section 38

Kingfisher Quay Plymouth. The last unit on our estate was sold in September 2008 and according to Plymouth City Council we have not been granted our section 38 as the estate is not finished to Planning conditions. This means as a community we have no road markings stopping parking on very narrow roads and on two occasions the emergency services were unable to gain access. How long are a company given to complete planning conditions ? We are being charged maintenance for this 'unfinished estate' is this in order as we still do not have the freehold to the estate? Jackie Without knowing the specifics of your case, it is difficult to provide any meaningful advice. Conditions will vary from one approval to another, although s38 is to do with Highways adopting the road after construction. If the roadway is not up to standard, it will remain the responsibility of the developer. I would suggest contacting the developer to get them to complete the roadworks to the satisfaction of the highway authority so that adoption can take place.
