Hi. Am I correct in saying the only way to clear up a part built eyesore of a development is through the route of a completion notice and then a discontinuance notice? We were hoping to use a s.215 amenity notice after the discontinuance notice but s.217(1)(b) which provides a ground of appeal in cases where the mess is a result of operations under Part III, would seem to scupper that. However the 2006 DCLG Research Report into Completion Notices gives case studies where a CN "clears the decks" (whatever that means) for a s.215 Notice, which makes it sound lik you can require the removal of the part built development. Has anyone any experience or success in these situations? Thanks Neil
