Adopting an SCI

Does anyone know under which regulation an SCI should be adopted? I know previously it would have been regulation 36 (Adoption of a DPD) but under the 2009 amendments regulation 24 was amended to remove reference to the fact that regulation 36 applied to an SCI. Regulation 26 now refers to the preparation of an SCI but doesn't refer to adoption. Thanks.

Good question! I've hit exactly the same problem. Some LPAs (e.g. Wiltshire) give no notice of the specific regs whereas others refer to amended regs: Wiltshire in June 2010 “The Statement of Community Involvement has been prepared in accordance with the requirements of the Town and Country Planning (Local Development) (England) Regulations 2004, as amended in 2008 and 2009.” See http://www.wiltshire.gov.uk/planninganddevelopment/planningpolicy/statementofcommunityinvolvement.htm Ashfield DC in Oct 2010 “In accordance with Regulation 24(4) and Regulation 36 of the Town and Country Planning (Local Development) (England) Regulations 2004 (as amended 2008)” see http://www.ashfield-dc.gov.uk/ccm/cms-service/stream/asset/?asset_id=12436001& I rang PINS to ask for advice. They said they no longer dealt with SCI and it was now “down to us”. They said their team was now so small unfortunately they no longer had the capacity to get involved in anything except DPDs. They advised that it “seemed sensible” to adopt it under the regulations as a whole, i.e. what Wiltshire did. I am going to use this approach. Hope this helps!
