SEA of Supplementary Planning Documents

Our planning solicitor is currently looking into whether or not SEA is required for SPDs. The SEA Directive states, in Article 2, that "For the purposes of this Directive: (a) "plans and programmes" shall mean plans and programmes, including those co-financed by the European Community, as well as any modifications to them: - which are subject to preparation and/or adoption by an authority at national, regional or local level or which are prepared by an authority for adoption, through a legislative procedure by Parliament or Government, and - which are required by legislative, regulatory or administrative provisions" It is this last sentence which we are struggling to interpret. SPDs are not required by any legisltaive or regulatory provisions, but might possibly be defined as being required by administrative provisions. Has anyone else looked into this and come to the conclusion that SEA is not required for SPDs?

Bang on they will require SEA if they pass the article 4/10/11 'significant effects on the environment' test which will normally require a screening test. If it passes no need. In many cases they will pass the article 10 small areas exemption 'When they determine the use of small areas at local level or are minor modifications to the above plans or programmes, they should be assessed only where Member States determine that they are likely to have significant effects on the environment.' This is precisely the procedure adopted by many LPAs, just do a google on 'SPD SEA Screening Report'

Andrea, I would be interested to know if your solicitor came up with anything? We received some advice from DCLG on neighbourhood plans but I would think it applies equally to SPDs. The advice was that as there is a statutory procedure prescribed for the preparation of a NP it is likely that they would be considered as 'required' by legislation. The following case also seems to back this up: http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?uri=CELEX:62010CJ0567:EN:HTML with paragraphs 24 to 32 being particularly relevant. Therefore I would suggest a SPD would meet the 'required' test.
