I see that the Government have issued a correction slip for the 2012 Regulations, changing "DPD" to "local plan" in regulation 17(d)(iv). Has everyone spotted this? I am just wondering why they didn't take the opportunity to correct regulation 34 at the same time. This is about authorities' monitoring reports and it requires the report to contain information about "the local plans or supplementary planning documents specified in the local planning authority's local development scheme" (regulation 34(1)(a) and (c)). But section 180 of the Planning Act 2008 removed the requirement for supplementary planning douments to be specified in the local development scheme, so the regulation is surely out-of-date. Am I misunderstanding this, or is the regulation perhaps referring to authorities who choose to include SPDs in their scheme even though they are not required to do so?
