Statutory Consultee Notification

In Poole, up to today we have always notified neigbours by post of any Planning decision if they have written in a representation on the application. From today we are directing them to the website if they are interested in the decision or contact us for further details via Customer Services. This should save a large sum of money in postage print etc. This has raised 2 questions , Do we need to legally notify the Statutory Consultee of the decision in writing ? or Do we only need to notify them if the decision is different to their recommendation. Any advise will be greatly appreciated. Regards Keith

The law is set out in the GDPO Article 8 and there is advice in DOE Circular 15/92. Neighbours are not statutory consultees - they are merely notified of an application. There is no statutory requirement to advise them of the decision, but it does seem to be good customer service. My suggestion would be to do what PINS do -ask them to say if they want to be told of the decision and whether email is available to them. If your software would allow it, an email of the decision would be cheap to handle and a bit more customer focussed than "look it up on the web". What proportion of your neighbours have access to the web? It would be cold comfort to be told "it'll be on the web" if you don't have access to it! Our applications software is pretty poor at handling neighbours details, so there isnt much scope to capture preference for us, but not all software is the same. HTH
