Clarification of new GPDO

Due to the large number of questions that were being posed with regard to varies aspects of the new GPDO the CLG have issued a letter to Chief Planning Officers at all Local Planning Authorities and it refers to a document posted at: http://www.planningportal.gov.uk/uploads/clg-pd-faq.pdf It makes interesting reading and clarifies a number of points relating to Class B developments.

What about the question whether the wall (from which the extension is built) fronts a highway. If it doesn't then it doesn't matter whether it is the principal elevation. There may be a very large front garden containing lawns trees and shrubs. Or there may be a paddock or field between the house and highway. Can there be any guidelines as to the kind of distance which would be needed, or whether it would make any difference if the land between the house and the highway was non-domestic (eg a farm field). It does not refer to fronting the highway which serves the property, a factor which may be relevant eg in bypassed villages, as it could be a different highway the house has ended up fronting. Anyone have any thoughts?

Also any thoughts on what is deemed "original dwellinghouse" when some parts have been demolished and replaced with new buildings on roughly the same footprint? Are they able to extend from only the parts of the house which still stand, or also from the new parts? The highway question is interesting also - does a public footpath count as a highway? And if a road is 1/4 mile away over other properties (i.e. only private land and tracks to the house) can it still be facing it?
