Retaining application fee

Does anybody have experience of retaining part of the application fee when an application is returned because it is invalid and the applicant does not or cannot submit the required information to enable validation? At the moment, we return the whole fee, but we are thinking of retaining part of it to cover our administrative costs. Mike Gilbert Vale of White Horse DC

The circular 04/2008 dated 6 April 2008 clearly states at para 101: "The fee due in respect of an application must accompany the application when it is submitted to the local planning authority, AND MUST BE REFUNDED IF THE APPLICATION IS REJECTED AS INVALID. Sorry we looked at trying to do this too. If anyone finds a loophole, please let us know. Chris Howell
