Keeping permissions alive - demolition

Have other people had situations where developers have claimed that purely by demolishing a commercial building following planning permission, then undertaking no other operations, that they have implemented their consent. Although demolition of a commercial building is not classed as development, demolition itself is classed as a material operation in Section 56 of the T&CP Act 1990- modified in 1991. Demolition is not in the description of the particular planning permission. There could be a significant delay after demolition before any construction commences - if at all.

This is address quite nicely in this weeks Planning (DC Forum/DC Casebook) - 10 Dec. It would appear that the demolition would represent a commencement on site - provided all relevant conditions have been discharged.
