Wind turbines - permitted by the GPDO or not ?

Part 40 Class H allows for the erection of a wind turbine on a domestic property, or does it ! It is permitted only if it complies with the conditions set out in H.2 and H.2 (h) precludes installation if it is on safeguarded land. The interpretation provided in Part 40, J includes within this designation land notified to the SofS by NATS (National Air Traffic Service), amongst others. We have just received a map of the extent of the land safeguarded by NATS with regard to wind turbines; this includes the whole of the land area of the UK. I understand this is the area NATS have notified to the SofS. This designation is obviously at odds with the safeguarded area geography used within the aviation tool hosted on the Planning Portal, referred to in the Chief Planners letter dated 5/12/2011.

Just a thought Denis. As I understood it one of the main reasons for delivering the safeguarding tool via the Portal was because it was deemed to be security risk to produce a map. Chris
