What is - and is not - a "householder application"?

I have applied for an NMA to connect to a private sewage plant rather than mains drainage following receipt of the necessary EA discharge exemption. The LPA says that I have to pay the non-householder application fee because the dwelling is not "complete and occupied". We are in occupation of the house and paying Council Tax although the house is not technically complete because we have not yet discharged all the (minor) planning conditions or completed all Building Regulations work. However, we have all the facilities that make the building habitable. Is the LPA right?

If there are still pre-occupation conditions outstanding then the dwelling is not yet lawfully occupied as a dwelling so I would agree with the LPA.
