Class J- office to residential conversions which include external alteratio

Does anyone have a view on how to proceed with a prior approval application from office to residential (Class J) where external alterations are proposed and details of these alterations are shown in the plans which are submitted? It appears there may be two (or more) options: 1. Return the application as Class J does relates to change of use only and therefore the proposal submitted cannot be considered under Class J. 2. Ignore the external alterations for the purposes of the prior approval application, determine it in relation to the change of use only, and include an informative on the decision notice confirming that the approval relates to change of use only and does not permit any external works.

Jonathan This has come up in another thread and the view seemed to be that you deal with the prior approval notice for the use and the external works as a separate planning application. This seems to be confirmed by the draft fee regs that from 1 Oct wil exempt the notice from a fee if a planning application is submitted on the same day in respect of the same property.

If they have included the eternal alterations with the prior approval for which planning permission is required this can not be an application for prior approval and the authority should advise the applicant of this and request withdrawal and resubmission of the prior approval application. I can see no reason why the applicant could not submit an application for the external alterations at the same time as the prior approval though I would have thought it would be better to wait for the approval of the prior especially as the LPA should not determine the planning application until the prior approval is granted
