Permitted development A extensions

Can anyone help - what is the position if you have a single storey rear extension that projects 10 foot - 3.1 metres and you want to put an extension on top forming a "2 storey extension" and the depth of the addition on top would be only 3 metres deep. The eaves would match the eaves of the existing semi detached house and the roof would be pitched but subordinate to the main roof with the new roof ridge below that of the main existing roof. As the distance to the boundary at the side of the house [i.e. between houses] then it is proposed that the side wall of a proposed second floor extension would be at least 2 metres from the boundary thus avoiding the restriction of eaves on the side having to be 3 metres maximum. I realise that this is an interpretation of the PD rules but anyone who can throw some light on this scenario would assist greatly. Ken McArdle

Hi Ken, As the existing single storey rear extension has length greater than 3.0m, any first floor rear extension on top of this existing extension will be contrary to limitation A.1(f). The above intepretation is supported by the following advice on page 20 of the DCLG "Technical Guidance" document: "Similarly, if a detached house has an existing, single storey, ground floor extension that was not part of the original house and which extended beyond the rear wall by more than three metres, then it would not be possible to add an additional first floor extension above this without an application for planning permission - because the enlarged part of the house would then consist of more than one storey and would extend beyond a rear wall by more than three metres."
