Does the new rules of there now being only 6 weeks in which to lodge a judiical review on a planing decisions apply to the production of a local plan or is it only decisions on planing applciations and if so does this inlcude the new prior approval process.
The deadline for challenging a local plan is 6 weeks already. Such a challenge would be brought under section 113 of the Planning and Compulsory Purchase Act 2004 and not by way of judicial review. The change to the judicial review rules applies to any decision under the Planning Acts, so that includes planning applications and prior approvals.
