An agent acting for the neighbour of a farm who want a change of use of a barn to offices under Part 3 Class M has said his clients will instigate legal proceedings as they say the forms are wrong.
They say that because the barn is under 150m2 there is no need to apply for prior notification. The farmer has used the 1APP form for prior notification, and we were going to say no application necessary.
Our solicitor says that because there is no statutory form for under 150m2 changes of use the use of any form is sufficent provided the minimum info is provided. We just need to make sure we articulate what we are determining... Given we should now be charging for priors i wonder if anyone has produced a form for owners to notify us of the the change of use as required by Part 3 M(2)
