Hello,

Wondering if anyone has come across this predicament before.

We submitted an initial householder application for a rear extension that was subsequently approved. The applicant later wanted to increase the roof height of the extension but the LPA would not accept it as a non-material amendment and so we resubmitted the application under a free-go.

Although a straight forward application, the LPA has taken over 26 weeks and has still not issued a decision. No extensions of time were ever agreed.

Are we entitled to any refund under section 9a of the 2013 Fee regulations? If not, does that mean an LPA can take as long as they want to determine a free-go application with no real penalty?

Would this be something worth pursing just for the precedent?

Any advice appreciated.
