CIL AND S106 SITE VISITS - Public forum - Planning Advisory Service (PAS)

Hi Bex,

My Sheffield City Council ID badge has wording on the back to allow me entry for site visits.  The wording is: - 

Sheffield City Council authorise Claire Woods to enter land and premises at all reasonable hours pursuant to the provision of Section 196A, 196B and 324 of The Town and Country Planning Act 1990, Section 88 of The Town and Country Planning Act (Listed Buildings and Conservation Areas) Act 1990, Reg 109 of the Community Infrastructure Levy Regulations 2010 (as amended) and Section 34 of the Clean Neighbourhoods and Environment Act 2005.

The same is on all Planning and Enforcement Officers ID badges.

Yes, at Torridge District Council planning officers have similar wording to what Claire mentions above on the back of our ID cards. To be honest, I'm not sure whether what we have would cover us for the purpose you state, particularly as we are not a CIL Charging authority, however happy to share the wording which is as follows:

"Authority to Enter Premises

The officer shown overleaf is hearby an authorised officer for the purposes of the following:

Town and Country Planning Act 1990 as amended:

Section 196A - Right to Enter Premises

Section 196B - Right to Enter Premises under warrant

Section 196C - Right of Entry

Section 214B - Right to Enter

Section 214C - Right to Enter under warrant

Section 324 - Rights of Entry

Planning (Listed Buildings & Conservation Areas) Act 1990 as amended

Section 88 - Rights to Enter premises

Section 88A - Rights to Enter premises under warrant

At Three Rivers DC I have an 'Authority To Enter' ID pass. It has my photo attached. The wording is:

This is to Certify that Deborah Wilson whose photograph and signaure shown opposite is the duly appointed Community Infratructure Officer of the Three Rivers District Council, and has been authorised by them to enter premises at all reasonable hours for the purpose  of her official duties, in pursuance of the statutory provisions on that behalf.

In witness where of the Common Seal of the Council was herunto affixed this (put the date in) in the presence of (signed by the Coucils head Solcitor and the Council seal)

At Havant Borough Council we monitor CIL and S106 developments in our Developer Contributions Team. Our wording is:

The holder of this card is hereby authorised to enter any land or building for the purposes descriibed in Section 324 of the Town and Country Planning Act 1990 and Section 109 of the Community Infrastructure Levy Regulations 2010, in proper pursuance of their duties in relation to Town and Country Planning and Community Infrastructure Levy Matters.

Hi, at New Forest District Council, we have similar to what others have listed (e.g. a list of the relevant planning acts that authorise us entry).

And let's not forget there are some important limitations such as

196 A (4)Admission to any building used as a dwellinghouse shall not be demanded as of right by virtue of subsection (1) or (2) unless twenty-four hours’ notice of the intended entry has been given to the occupier of the building.
