Is it possible for a Council to impose a 'blanket' article 4 direction for all properties in a conservation area which then also covers new build properties?  This to me seems like the wrong approach as it imposes far too many restrictions on buildings where the original character is already gone (for example requiring an application for replacement windows when the windows themselves are modern upvc or for alterations to the roof when the roof is not original or characteristic). I understand that certain pd rights can be restricted through the use of an article 4 and this is necessary and justified in some cases.  But would it extend to new build properties where you can restrict pd rights through conditions?

Can anyone advise me if this is actually incorrect use of an article 4 direction or just perhaps a misinterpretation of the article 4?

I have attempted to find this out through the Planning Law encyclopeadias but I am still unsure.
