HERs operate within a framework of legislation, national and local planning policies, and associated guidance, which together provide for the protection and management of the historic environment and its presentation to the public.

This section outlines the current legislative frameworks relating to HERs in England, Scotland, Wales and Northern Ireland. It also sets out the relevant planning policies that sit beneath this legislative framework, and the implications of these for HERs. Historic England host a comprehensive guide to the law, policy and guidance that protects the historic environment in England. Historic England’s monthly Planning Bulletin highlights recent and forthcoming developments in planning from a heritage perspective.

Historic Environment Scotland shares the legislation applicable to Scotland. However, this only covers designated sites and not national planning policy or Treasure Trove.

Cadw set out the relevant legislation applicable to Wales. They also share details of current policy, advice and guidance.

In Northern Ireland, the Department for Communities sets out the legislation applicable to Northern Ireland.
